CHILD WATCH WAIVER AND RELEASE OF LIABILITY:

In consideration for MOVE (“MOVE”) providing access to Child Watch services, I hereby agree that:

I understand that MOVE’s Child Watch is a short-term, on-site supervision service offered as a convenience for parents or guardians attending classes or services at MOVE. I acknowledge that this service is not licensed child care, does not provide educational or developmental programming, and is not intended to replace professional child care. I understand that MOVE does not operate as a licensed child care provider and that Child Watch is not subject to the regulations that govern such facilities.

I understand that Child Watch is available for children ages 2 years and older, and that MOVE reserves the right to limit participation, modify policies, or deny service based on capacity, safety, or behavior concerns at its sole discretion.

I acknowledge that I am required to remain physically present on the premises of MOVE at all times while my child(ren) is/are in Child Watch. I understand that I must be immediately reachable and available during the entire time my child is under MOVE’s supervision, and I will provide accurate and current emergency contact information. If I leave the premises for any reason, I will immediately retrieve my child(ren).

I certify that I am the parent or legal guardian of the child(ren) listed below and that I have full authority to execute this waiver on their behalf. I acknowledge that it is my responsibility to ensure that my child(ren) are in good health and free from contagious illness before entering Child Watch. MOVE reserves the right to deny or discontinue participation if a child exhibits signs of illness, disruptive behavior, or poses a safety risk to others.

I understand that there are inherent risks associated with the use of Child Watch, including but not limited to: minor injuries (such as bumps, bruises, or scratches), illness transmission, allergic reactions, emotional distress, interactions with other children, or accidents during supervised play. I voluntarily assume all risks, known and unknown, associated with my child(ren)’s presence in and use of Child Watch services.

I authorize MOVE to take reasonable steps to obtain emergency medical care for my child(ren) if necessary and agree that I am solely responsible for any associated medical costs or expenses incurred as a result.

I, for myself and on behalf of my child(ren), heirs, assigns, successors, executors, administrators, and legal representatives, hereby fully and forever release, waive, discharge, and covenant not to sue MOVE, its affiliates, officers, directors, agents, servants, employees, volunteers, contractors, or the landlord of any premises at which it may operate, for any and all claims, demands, damages, or causes of action of any kind arising out of or related to injury, illness, death, or property loss sustained in connection with the use of Child Watch, except in cases of gross negligence or willful misconduct.

I agree to defend, indemnify, and hold harmless MOVE, its affiliates, officers, directors, agents, servants, employees, contractors, and the landlord of any premises at which it may operate, from and against any and all claims, suits, losses, or demands (including attorney’s fees and costs) brought by anyone arising out of or related to my child(ren)’s participation in Child Watch, including but not limited to claims brought by other parents, guardians, or third parties.

I understand and agree that any photography or videography taken while my child(ren) is/are present in Child Watch may be used by MOVE for internal marketing and promotional purposes, including use on MOVE’s website, social media, and printed materials. I consent to the use of my child(ren)’s likeness in such materials, waive any right to approve the final use, and waive any right to compensation.

I acknowledge that MOVE reserves the right to suspend or revoke access to Child Watch at any time, without prior notice, due to illness, safety concerns, disruptive behavior, or violation of these terms. I also understand that Child Watch is offered as a service and may be suspended, modified, or discontinued at any time without obligation or liability.

By signing up for or utilizing Child Watch services, I confirm that I have read and understood this Child Watch Waiver and Release of Liability and voluntarily agree to the terms and conditions outlined above on behalf of myself and my child(ren), and I certify that I am the parent or legal guardian of the child(ren) listed and have full authority to execute this agreement on their behalf.
